General Terms and Conditions These General Terms and Conditions (hereinafter, the "Terms") govern access to, browsing, and use of the Cursosdebuceo.com website (hereinafter, the "Website" or the "Platform"), as well as the conditions for contracting the services offered through it, chiefly the online booking of scuba diving courses from various specialized centers. By accessing and using this Website—and especially by registering as a user or purchasing a course—you (hereinafter, the "User") fully accept these Terms and are legally bound by them. If you disagree with any of these Terms, you must refrain from using the Website. Please read this document carefully. 1. Identification of the owner (Legal Notice): In compliance with the information duty set out by Law 34/2002 (LSSI-CE) and other applicable regulations, the identifying details of the owner and person responsible for the Website are provided below: Website Owner: Yuliia Kliusa (hereinafter, the "Owner"). This information enables users to identify the provider of the web service, in accordance with the LSSI, and is permanently accessible for users’ information. Likewise, the Owner is the individual acting as a sole proprietor providing the services offered on the Platform. 2. Acceptance and scope of the terms of use: Use of Cursosdebuceo.com confers the status of User and implies unconditional acceptance of all provisions contained in these Terms, in the version published at the time you access the Website. These Terms will also be available at all times on the Website (usually linked in the footer under "Terms and Conditions" or a similar section) so that the User may consult, download, or print them at any time. By using Cursosdebuceo.com, the User declares and warrants the following: Age and legal capacity: The User is at least 18 years old and has full legal capacity to enter into binding contracts. The Platform is intended exclusively for adults; by accepting these Terms you certify that you meet this requirement. Legitimate use: The User will use the Website and the services offered solely for lawful and personal purposes, in accordance with these Terms and the applicable law. In particular, if booking courses, the User undertakes that such bookings will be legitimate, non-speculative, neither false nor fraudulent. Accuracy of information: All personal or contact information provided during registration or booking is truthful, accurate, current, and complete. The User is responsible for keeping their account details up to date. Bookings for third parties: If the User books a course on behalf of another person (for example, enrolling a friend or purchasing a gift) or for a group, they warrant they are authorized by such beneficiaries to do so, and that they will inform them of these Terms and all booking details. Any third party using a booking made by the User is deemed to accept these Terms upon use. Compliance with course rules: The User acknowledges that diving courses may require compliance with certain prerequisites (for example, holding a lower-level certification to enroll in an advanced course, having a valid medical certificate, being able to swim, having no health contraindications, etc.) and undertakes to meet the requirements indicated in the course description or by the dive center. Likewise, the User agrees to comply with the center’s rules and instructions during the course, particularly those related to safety. Breach of any of these warranties by the User may result in immediate cancellation of their account or bookings and, where appropriate, the liabilities established by law. 3. User registration: To access certain features of the Website, such as booking courses, you must register and create a user account. The registration process will require you to provide certain personal data (see our Privacy Policy). The User must choose an identifier (for example, their email) and a secure password. The User is responsible for maintaining the confidentiality of their login credentials. The User agrees not to disclose their password to third parties and to promptly notify the Owner in case of suspected unauthorized use of their account or any security breach. The Owner shall not be liable for any damage or loss arising from the User’s failure to comply with this obligation. Each User must register with a single account; creating multiple accounts for the same person or impersonating another person or entity is not permitted. The data provided during registration must be truthful and belong to the User; the use of false identities or third-party data without consent is not allowed. The Owner reserves the right to verify the User’s identity and the accuracy of the information provided. If, after registration, it is detected that a User has provided false, inaccurate, or incomplete data, or violates these Terms, we may suspend or cancel the account and inform the User accordingly. Registration on the Platform is free of charge. Once completed, the User may access their personal dashboard/profile to manage their data, view bookings, etc. The User may cancel their account at any time by requesting it via the contact email or via any functionality enabled for that purpose, if available; account cancellation does not exempt compliance with obligations already undertaken (for example, attending a booked course or paying outstanding amounts). 4. Website usage rules: The User undertakes to use Cursosdebuceo.com in a proper, lawful, and respectful manner, in accordance with these Terms and applicable law. When using this Platform, the User must refrain from, among other actions: Using the Website for unlawful, fraudulent, or unauthorized purposes or effects, or in any way that could damage, overload, or impair the Website’s infrastructure, reputation, or performance, or that of third parties. Publishing, transmitting, or distributing via the Website content that is defamatory, obscene, offensive, violent, discriminatory, that incites hatred, illicit, or contrary to morality and public order. It is prohibited to introduce or spread viruses or other malicious code, files, or programs designed to interrupt, destroy, or limit the functionality of any software, hardware, or telecommunications equipment. Attempting to access without authorization any section of the Website, other accounts, computer systems, or networks connected to the service, by hacking, password extraction, or any other unlawful means. Likewise, it is prohibited to probe, scan, or test the vulnerability of the Website or any related system or network, breaching security or authentication measures. Using bots, spiders, or other automatic devices, programs, scripts, or any manual or automated process to extract, collect, or monitor data or content from the Website without our express consent (scraping or any form of massive extraction of information from the Platform is prohibited). Infringing intellectual or industrial property rights of the Owner or third parties (see the Intellectual Property section below). This includes not reproducing, duplicating, copying, or exploiting Website content in an unauthorized manner. The User will be liable for any breach of these obligations vis-à-vis the Owner and affected third parties. If unauthorized or prohibited use is detected, the Owner may take any measures deemed appropriate, including suspension or termination of the infringing User’s account, cancellation of associated bookings, and, where applicable, initiating legal action. 5. Description of services – Offered diving courses: Cursosdebuceo.com is an online platform acting as an intermediary between Users interested in taking diving courses/experiences and professional dive centers that offer such courses. Through the Website, the User may review detailed information about each available course (description, requirements, duration, price, location, available dates, language, etc.), compare offers, and formalize firm bookings. The Owner endeavors to ensure that the information displayed for each course (including photographs, descriptions, and prices) is as accurate, up to date, and truthful as possible. Such information is largely provided by the dive centers themselves (the service providers). However, we cannot guarantee that every detail is 100% accurate or free of typographical errors. For example, there may be minor changes to the course plan due to weather conditions, instructor decisions to ensure safety, or other factors. Images are illustrative and may not correspond exactly to the real experience. Cursosdebuceo.com is not responsible for small divergences or last-minute modifications in course execution by the center, provided they do not substantially alter the nature of the service contracted. In any case, if the User notices unclear or potentially erroneous information, we encourage contacting us or consulting directly with the center before booking. Please note that Cursosdebuceo.com is not the direct organizer of diving activities, but an intermediary that facilitates contracting between the User and the dive center. The service contract for the diving activity (course, dive, excursion, etc.) is understood to be concluded directly between the User and the providing dive center, with Cursosdebuceo.com acting as an intermediary that manages the booking and collects payment on behalf of the center. Nevertheless, for the User’s convenience, the Platform centralizes the booking and payment process and issues a valid voucher (QR code) that the center will accept as proof of contracting. Obligations and responsibilities related to the material execution of the course (for example, quality of instruction, safety during dives, availability of equipment, compliance with diving technical regulations, etc.) fall primarily on the dive center that conducts it, without prejudice to the customer assistance that Cursosdebuceo.com provides as an intermediary. 6. Booking process and contracting courses: To purchase a diving course via the Platform, the User must follow these general steps: Course selection: Browse by categories or use the search to find the desired course. Each course page will display essential information: description, prerequisites, duration, total price (including taxes), what is included and not included, the center’s location, available dates or schedules, language of instruction, applicable cancellation policy, etc. The User must select, where appropriate, the preferred date and time (or date range) from those offered, the number of participants to enroll (if the course allows multiple students per booking), and any other available option (for example, instructor language if applicable, additional equipment rental, etc.). Pre-booking information: Before confirming the booking, the Platform may show a summary with all selected details and the itemized price. We recommend reviewing this information carefully. The User must provide the necessary details for each participant if requested (for example, full name, age, previous certification if applicable, equipment size, etc.), as well as contact details (email and mobile phone) where booking communications will be received. It is important to verify that the data provided are correct, as the effectiveness of the booking depends on it (for example, an incorrect email means not receiving the confirmation). Payment of the booking: To confirm the purchase, the User must proceed to pay the indicated amount. The Platform will redirect the User to the secure Stripe payment gateway, where the User can enter credit or debit card details (or other accepted payment methods, if any) in an encrypted and secure manner. All prices are shown in USD / EUR and include applicable taxes (unless otherwise indicated in specific cases); the User will see the final price before proceeding to payment. Upon initiating the payment process, the User may be required to authenticate via banking security systems (for example, 3D Secure verification, an SMS code from their bank) to authorize the transaction. If payment is declined or not completed correctly, the booking will not be confirmed. In such case, the User should verify the details and try again, or contact their bank or our support if the issue persists. Booking confirmation: Once Stripe or another provider notifies us that payment has been successfully made, the booking is confirmed. Cursosdebuceo.com will display an on-screen confirmation message and send the User a confirmation email to the provided address. This email will contain the booking details (course, date, participants, dive center, amount paid) and, importantly, will include the QR code or downloadable digital voucher that serves as proof of booking. In some cases, the User may also download the receipt from their user area on the Website. From that moment, the contract between the User and the dive center is considered formalized and binding on both parties. Cursosdebuceo.com also automatically communicates the booking to the dive center’s system so it receives the information and expects the User on the agreed date. Check that the confirmation email has not landed in the spam folder; if it is not received within a few minutes, please contact us. The electronic contract is deemed concluded when the User manifests their will to purchase by clicking the confirmation/payment button and the system validates the transaction. Cursosdebuceo.com will store a record of the transaction. The language in which the contract may be concluded is, for now, Spanish (we may offer translations to other languages for the User’s convenience, but the Spanish version will prevail in case of discrepancy). 7. Prices and payment method: The prices of the courses published on Cursosdebuceo.com are set by the providing dive centers. Unless otherwise stated, prices are expressed in USD / EUR and include VAT or other applicable taxes at the prevailing rate, as well as any applicable fees. Any discounts or promotions will be applied under the specified conditions. Before confirming the booking, the User will see the total price to be paid, itemized where applicable. No additional charges will be applied that have not been expressly stated. Payment is made on a prepayment basis; that is, the User pays 100% of the amount at the time of booking via the Platform’s payment gateway. This amount covers the cost of the course purchased. Cursosdebuceo.com, acting as an intermediary, will collect such amount on behalf of the dive center and issue the corresponding receipt. Subsequently, the Platform will settle the center’s share, deducting (if so agreed) an intermediation commission. The User will not have to pay anything else to the center upon arrival (unless voluntarily contracting additional services or extras not included in the booking, such as special equipment rental, photos, etc., which would be outside the initial contract). The currently accepted payment method is by bank card (credit or debit) from major providers (Visa, Mastercard, possibly others). All payments on the Website are processed securely through Stripe, which complies with PCI DSS security standards. Cursosdebuceo.com does not store card data; such information is transmitted directly, encrypted, to Stripe’s servers. Once payment is completed, Stripe informs us of the result (approved or declined), and we only keep a transaction identifier and the last digits of the card for reference. The User must ensure sufficient balance or credit limit to cover the purchase amount. If, after payment has been collected, we detect a pricing error (for example, a patently erroneous price due to a technical failure), we will contact the User as soon as possible to offer the option to reconfirm the booking at the correct price or to cancel it with a full refund. If it is not possible to contact the User, the booking will be considered canceled and the amount paid will be refunded. Cursosdebuceo.com may issue, upon the User’s request, an invoice for the amount paid. Since the final service is provided by a dive center, the invoice may be issued by the center itself with our details as intermediary. In any case, the User may use the receipt or confirmation email as proof of purchase. **Currency and Exchange Rate** All course prices published on cursosdebuceo.com are expressed and charged in United States Dollars (USD), with the exception of transactions made from the European Union, which will be expressed and charged in Euros (EUR). For convenience, the platform may show the user estimated amounts in other local currencies. These amounts are for informational purposes only and are calculated using approximate exchange rates. The final charge is always made in the reference currency (USD or EUR as applicable). When the user's payment method is associated with an account in a different currency, the card issuing entity or the user's bank will perform the conversion to the local currency, applying their own exchange rate and, where applicable, fees for foreign currency transactions. cursosdebuceo.com does not intervene in such conversion, does not control the applied exchange rate or the fees that the user's financial institution may apply, and is not responsible for any differences that may exist between the estimated amount shown on the website and the amount finally charged. In the event of a return or refund, this will always be made in the original currency of the charge (USD or EUR). The conversion of said amount to the currency of the user's account will be performed again by their financial institution, applying their exchange rates and fees in force on the date of the operation. 8. Delivery of the voucher (QR code) and documentation: As mentioned, after completing the booking, the User receives a unique QR code that constitutes the booking voucher. This code (which can be presented digitally on a phone or printed) will be required to redeem the booking at the dive center on the day of the course. The User is responsible for keeping this QR code in a safe place and not sharing it publicly to avoid fraudulent use by third parties. The code contains an identifier associated with the booking; the dive center will scan or verify it against the list of confirmed bookings. Each QR code can be used only once and becomes invalid after first use. Along with the QR, the User must show up at the center with the necessary documentation as specified: for example, valid identification (DNI, passport) to verify ownership of the booking, and, where applicable, a valid medical certificate (if local regulations require one for diving—generally issued within the last 1–2 years), as well as prior diving certification (brevet) if the course requires a previous level. The dive center has the right to deny participation in the course (without a refund) to Users who cannot properly identify themselves or who fail to provide the necessary documentation/prerequisites to carry out the activity safely (for example, if a student in an advanced course cannot prove they hold the Open Water title, or if they do not present a mandatory medical certificate, the center may prevent the dive for legal and safety reasons). The meeting point and schedule for the course are indicated in the confirmation. The User must arrive punctually at the agreed address (e.g., the center’s premises or the embarkation pier) on the specified date and time. We recommend arriving a little early (e.g., 15 minutes) to handle preliminary formalities (signing the center’s liability waiver, trying on equipment, etc.). If the User is late or does not show up (no-show), the cancellation/no-show policy described below will apply. The center is not obliged to delay the start of the course due to one participant’s tardiness, especially if there are more participants. 9. Cancellations, changes, and refunds policy: We understand that unforeseen events may arise that require the User to cancel or modify their booking, or that circumstances may compel the center to cancel the activity. The applicable terms are as follows:
Withdrawal (purchases without a fixed date): If the User purchases a course without selecting a specific date, they have 14 calendar days to withdraw from the purchase without justification and with a full refund, provided the voucher has not been redeemed and no date has been set.
Selection of date and loss of the right of withdrawal: When the User selects a specific date for the course, and is clearly warned and ticks the corresponding confirmation box, the User acknowledges that they lose their 14-day right of withdrawal pursuant to Article 103.l of the Spanish Consumer Law (TRLGDCU) (leisure services with a defined date or period of execution).
From the moment a date is set, any User request is governed by the commercial policy of changes and cancellations indicated below. Cancellation by the User (before the course date): The User may request cancellation of their booking at any time prior to the start date of the course, via our contact form at https://cursosdebuceo.com/home/contacto (or via the cancellation functionality enabled on the Platform, if available). The date and time of receipt of the cancellation request will determine possible refunds according to these rules: If the cancellation is requested 7 or more days in advance of the course start, the User will be entitled to a 100% refund of the amount paid. If the cancellation is requested between 2 and 6 days in advance (between 48 and 144 hours before) the course start, 50% of the amount paid will be refunded. The remaining 50% will be retained to cover late cancellation costs and to compensate the center for the reserved slot. Alternatively, subject to the center’s availability, we may offer the User a voucher or credit for that retained 50% to use on another date or course as a courtesy, but this is not guaranteed. If the cancellation is requested less than 48 hours in advance, or the User fails to show up on the course day without prior notice, no refund will be issued. It will be considered that the service was offered and not used by the User’s decision. These time frames apply unless the course description or the center’s specific conditions set out different policies (for example, some long-duration courses or dive trips may require more advance notice). Where stricter provider-specific policies exist, they will be communicated before booking and will prevail over the general ones. In the absence of specific indications, the general rules described above apply. Refunds will be made using the same payment method used in the booking (e.g., refund to the same card). Please note that, after our processing, the credit may take a few days to show in your account depending on your bank. Changes of date or other modifications by the User: If the User wishes to change the course date or make a modification (for example, change participants) instead of cancelling entirely, they must contact us as soon as possible. We will do our best to manage the change with the dive center, always subject to availability and its acceptance. Reprogramming is not guaranteed, but we will try to accommodate the request. Changes requested with short notice (less than 48h) may be treated as cancellation and new booking, applying the corresponding refund policy. Cancellation by the center or the Owner: In certain circumstances, the dive center reserves the right to cancel or reschedule a course. This may occur for safety or force majeure reasons, such as adverse weather conditions that prevent safe diving, serious technical issues with facilities or boats, instructor unavailability without a replacement, failure to reach the minimum number of participants required for the course, or unexpected restrictions (e.g., health alerts, closures of dive areas), among other justified causes. In the event of a cancellation initiated by the center (or by Cursosdebuceo.com on its behalf), the User may choose between: (a) accepting a proposal for a new date or a course change of equivalent value (if convenient); or (b) requesting a full refund of the amount paid. This refund would be 100%, regardless of the timing of the cancellation, since it is not attributable to the User. We will not be responsible for additional expenses the User may have incurred for travel or arrangements (for example, transportation to the course location, accommodation) outside the scope of the course, so please take this into account when making plans. The dive center and/or Cursosdebuceo.com will inform the User as soon as possible if such a cancellation occurs, using the contact details provided. We ask the User to keep an eye on their messages (email and phone), especially in the days leading up to the activity, in case there are important communications. Interruption during the course: If, once the course has begun, it must be interrupted or suspended due to force majeure (for example: sudden hazardous weather, a critical boat breakdown during an outing, etc.), the center will attempt to offer alternatives (such as resuming later in the day or on a different day) to complete the activity. If it is not possible to continue and the User received only part of the service, the center and Cursosdebuceo.com will assess a proportionate partial refund for the unused part, or a discount voucher for another activity, depending on the specific case. If the User, on their own initiative, decides to abandon or not complete the course once started (for example, feels unwell during a dive and opts not to continue, or simply changes their mind halfway through), they will not be entitled to a refund for the unused portion, since resources and slots had already been reserved for them. This does not affect the User’s possible liabilities if damage was caused. Refund procedure: For any refund approved under the above cases, Cursosdebuceo.com will process the return via Stripe (or the original payment method) without undue delay once the cause of the refund is confirmed. From the moment we issue the return order, the time for it to become effective depends on the User’s payment provider (card-issuing bank, etc.), typically between 5–10 business days. If, after that time, the credit is not received, please contact us and your bank to verify. These cancellation and refund policies seek a balance between flexibility for the User and the dive centers’ need to plan their activities (reserve boat places, assign instructors, etc.). Remember that, by booking a course for a specific date, you are blocking a slot that other divers will not be able to occupy; hence penalties apply if you cancel at short notice. Nevertheless, we will always try to assist the User and seek amicable solutions in the event of any incident. Right of withdrawal: In distance contracts (such as online bookings) concluded with consumers, Spanish law grants a general period of 14 calendar days for withdrawal (unilaterally cancelling) without the need for justification. However, this regulation provides exceptions for certain services. In particular, under Article 103(l) of Royal Legislative Decree 1/2007 (General Consumer and User Law), the right of withdrawal does not apply to contracts for leisure or entertainment services when these are scheduled for a specific date or period. This applies to the booking of diving courses or other leisure activities with a determined date. Therefore, once the booking of a course for a specific date is confirmed, the User cannot freely withdraw within 14 days to obtain a refund, as the aforementioned legal exception applies. Cancellations will only be possible under the terms described in the previous section (Cancellation Policy) or if any legal grounds for termination of the contract concur. By accepting these Terms and making a booking, the User acknowledges and consents to the service being executed on the requested date, being aware that the statutory right of withdrawal is lost as it concerns a dated service. 10. Redeeming the booking and participating in the course: The User must appear at the selected dive center on the confirmed date and time, carrying their booking QR code (digital or printed) and personal identification. The dive center will verify the QR to validate the booking. The center may also require the User to complete and sign certain forms before the activity, such as a medical form or a standard recreational diving liability waiver, and to present documentation such as their diving certification (if required by the course) and a recent medical certificate declaring fitness to dive (according to local regulations—generally mandatory if none has been presented in the last 2 years, especially in Spain). It is the User’s responsibility to obtain such medical certificate in advance if needed. During redemption and the activity, the User must follow all instructions from the center’s staff, comply with established safety measures, and cooperate by providing accurate information about their health status and experience (for example, informing the instructor if they have not dived in a long time, if they take any medication that could affect them, etc.). The center reserves the right to refuse participation or expel from the course (without a refund) any student who: Does not meet essential prerequisites for the activity (minimum age, required prior certification, valid medical certificate if required, etc.). It is the User’s duty to review these requirements before booking and to meet them on the day of the activity. Shows up in a condition not suitable for safe diving—for example, under the influence of alcohol or drugs, or in an extreme state of fatigue that compromises safety. Diving requires full faculties; the center may deny diving to anyone not in optimal condition. Engages in seriously inappropriate behavior or acts contrary to safety instructions (e.g., refusing to follow the instructor’s indications, willfully endangering themselves or others). In such situations, it will be considered a late cancellation by the User (ex tempore) with no right to a refund, since the company will have allocated resources for the course. This does not affect potential liabilities of the User if damage was caused. Conversely, if the User is unable to perform the dive due to a justified last-minute reason (for example, a sudden medical issue on-site communicated before starting, such as severe congestion preventing ear equalization), the center and Cursosdebuceo.com may assess the situation and, if feasible, try to offer a date change or a partial credit as a courtesy, although they are not obliged to do so. Once the course or diving experience has concluded, the User may be asked to sign a completion form or leave a review. We encourage Users to share comments or reviews about the activity, as this helps maintain service quality (if the Platform implements a review system). Any suggestion or incident may be communicated directly to us for investigation with the center. 11. Limitation of liability: Cursosdebuceo.com, in its capacity as intermediary, is responsible for the obligations pertaining to platform and booking management, but does not assume responsibilities arising from the material execution of the diving course, beyond what is established by law. In particular: Liability for the diving service: The course contract is established directly between the User and the dive center. Therefore, the center (provider) is primarily responsible for the proper provision of the service (course content, safety of dives, equipment quality, instructor qualifications, compliance with local diving regulations, etc.). Cursosdebuceo.com is not responsible for acts, omissions, negligence, or breaches by the dive center during execution of the course, nor for any damage, personal injury, accident, death, material loss, or other harm that may occur during the diving activity. The User acknowledges that recreational diving involves inherent risks—even under professional supervision—and assumes such informed risks by participating in the course. Nevertheless, dive centers usually carry liability insurance that would cover potential incidents during the activity; in the event of an incident, the User should address claims to the corresponding center. Cursosdebuceo.com will cooperate as far as possible to facilitate contact and resolution but is not directly responsible. Accuracy of information and changes to the activity: While we strive to ensure the Platform’s information is reliable, we cannot guarantee total accuracy, completeness, or timeliness at all times. Cursosdebuceo.com shall not be liable for unintentional errors or omissions in course descriptions or for last-minute modifications made by centers (provided they are reasonable changes that do not significantly alter the contracted service). Nor do we guarantee the permanent availability of all listed courses, as slots may sell out or specific dates may be canceled. We reserve the right to correct pricing or detail errors, informing the affected User to reconfirm or cancel the booking at no cost (as previously indicated). Website operation: We do not guarantee uninterrupted or error-free access to the Platform. There may be times when the Website is temporarily out of service due to technical maintenance, improvements, server failures, or external causes (e.g., Internet issues, attacks, etc.). Cursosdebuceo.com shall not be liable for any damages the User may suffer due to service interruptions, access problems, slowness, or failures in Website availability, insofar as such incidents arise from causes beyond our reasonable control (force majeure, acts of third parties, etc.). In any case, as soon as we become aware of technical problems, we will attempt to restore service as soon as possible. The User understands that using the Internet implies risks beyond the Owner’s control with respect to communication security. We recommend the User ensure their devices have protective measures (antivirus, etc.) and use trusted networks. Relationship with third-party sites or services: The Platform may contain links to external websites or integrate third-party services (for example, maps, translation services, social media buttons). These sites and services are operated by independent third parties and are offered for User convenience. Cursosdebuceo.com has no control over them and therefore assumes no responsibility for their content, privacy policies, or practices. Inclusion of such links does not imply we endorse the information or services offered by third parties. The User accesses linked external sites at their own risk. Force majeure events: None of the parties (Owner, center, or User) shall be liable for breaches due to force majeure or circumstances beyond their reasonable control, such as natural disasters, pandemics, wars, governmental actions, general strikes, massive power or Internet outages, terrorist attacks, etc., that temporarily prevent fulfillment of obligations. If a force majeure event affects the development of a course (for example, severe maritime storms), we will proceed as described in the cancellation by center policy (reschedule or refund). No additional compensation will be due for these reasons. Damages cap: To the extent permitted by law, the total aggregate liability of Cursosdebuceo.com to the User for any concept (contractual, tort, statutory, etc.) shall be limited—absent willful misconduct or gross negligence—to the amount actually paid by the User for the course booking giving rise to the claim. Under no circumstances shall Cursosdebuceo.com be liable for indirect, special, or consequential damages, such as loss of opportunity, lost profits, loss of enjoyment, cost of substitute services, etc., that may arise in connection with use of the Platform or the contracting of courses. This limitation does not exclude or limit liability in cases where it cannot be limited by law, such as personal injury caused by our own gross negligence. However, given our role as intermediary, such situations generally do not apply directly. The User acknowledges that, when contracting a diving service through our Platform, they may also be subject to the dive center’s particular conditions and liability waivers (for example, a standard recreational diving waiver). Cursosdebuceo.com does not control the content of those documents, but it is common practice for centers to require acceptance of certain safety rules and an acknowledgment of inherent risks. A User’s unjustified refusal to accept such specific conditions from the center could prevent participation in the activity and be deemed a cancellation by the User without a right to a refund. We therefore recommend reviewing in advance any documentation the center provides. 12. Intellectual and industrial property: All contents and elements forming part of the Cursosdebuceo.com Website—including, without limitation, the platform design, texts, descriptions, photographs, graphics, images, logos, trademarks, trade names, software, source code, as well as the compilation, selection, and arrangement thereof—are protected by intellectual and industrial property rights owned by or legitimately licensed to the Owner. The User acknowledges that access to and use of the Website does not grant any ownership rights over said contents. It is strictly prohibited to reproduce, distribute, publicly communicate, transform, or otherwise exploit the contents of Cursosdebuceo.com, in whole or in part, for commercial or profit-making purposes, without the prior express written authorization of the Owner or the legitimate rights holder. In particular, the User must not remove or alter copyright notices, trademarks, or other rights-identifying data embedded in the contents. By way of exception, the User may view and obtain a temporary private copy of the contents for their exclusive personal and domestic use, on their computer or device, provided this is not for business or professional purposes. For example, printing the booking confirmation or downloading the QR voucher PDF for personal use is permitted. Any other use—even when citing the source—requires permission. The trademarks, trade names, or distinctive signs appearing on the Website (for example, the name and logo "Cursosdebuceo.com") are owned by the Owner or by collaborating third parties and are protected by trademark laws. It is prohibited to use them, imitate them, or insert them except in cases permitted by law. The User undertakes to respect all intellectual and industrial property rights over the Website. Infringement of these rights may give rise to legal action, including claims for damages. If the User detects any violation of intellectual property rights on the Platform (for example, that some content infringes third-party copyrights), please inform us so that we can take appropriate measures. 13. Amendments to the Terms: The Owner reserves the right to modify or update these General Terms at any time, for legal, technical, or operational reasons, or due to changes in the services offered or the business structure. When this occurs, we will publish the new version on the Website, indicating the date of the latest update at the beginning of the document. If the changes affect the User’s substantial rights, we may notify them via the registered email or by a prominent notice on the Platform. In any case, it is the User’s responsibility to periodically review the current Terms. Continued use of the Website after the changes take effect will constitute acceptance of the amended Terms. If a registered User does not agree with the new terms, they may cancel their account before they come into force. 14. Governing law and dispute resolution: Use of Cursosdebuceo.com and the service contracts for diving courses concluded through the Platform shall be governed by and construed in accordance with Spanish law, unless there is a mandatory rule of public policy from another jurisdiction that applies. This choice of law will not deprive a User who is a consumer of the protection afforded by mandatory provisions of their country of residence, if different (pursuant to Regulation (EC) 593/2008, Rome I). In the event of any dispute or claim arising from the interpretation or performance of these Terms or the use of the service, the parties agree to first seek an amicable solution. The User may contact us through the contact form at https://cursosdebuceo.com/home/contacto to lodge a complaint or claim, and we will endeavor to respond and resolve it within a reasonable time. If the dispute is not resolved amicably, the User, as a consumer, may opt for out-of-court dispute resolution mechanisms available to them. In particular, the User may, if desired, turn to public consumer mediation or arbitration services in their locality (for example, Consumer Arbitration Boards), always on a voluntary basis for both parties. Cursosdebuceo.com is not formally adhered to any specific consumer arbitration system, but may consider submitting the dispute to consumer arbitration if the User requests it and the regulations so provide. Likewise, the User may seek information or assistance from the Municipal Consumer Information Office (OMIC) or equivalent in their Autonomous Community to process their claim through the administrative consumer route. (Note: Until March 2025 there existed a European online dispute resolution (ODR) platform under Regulation (EU) 524/2013, but it has been discontinued by the European Union and is currently not operational). Ultimately, if judicial action is necessary, both parties submit to the jurisdiction of the Courts and Tribunals of the city of Barcelona (Spain) for the resolution of any dispute, unless another mandatory forum is legally established. This means that, if the User is a consumer and the law provides for the jurisdiction of the User’s domicile, such forum will prevail and any legal action shall be brought before the courts corresponding to the consumer’s domicile. In cases where the User is not deemed a consumer (e.g., disputes with businesses or professionals), or when the law allows it, the express submission to Barcelona shall apply. In any case, neither the User nor Cursosdebuceo.com waive, by this clause, their rights to take action or defend themselves in accordance with applicable law. This jurisdiction clause is made with full respect for the consumer rights recognized by current regulations. 15. Contact and support: For any questions about these Terms, the operation of the Platform, or any incident or claim, the User may contact the Owner through the forms available on the Website "https://cursosdebuceo.com/home/contacto". We will endeavor to handle all communications as diligently as possible. By accepting these Terms, the User acknowledges having read, understood, and accepted them in full.
